General Terms and Conditions (GTC) for Olyscake by Alexandra Burger

1. Scope
   These General Terms and Conditions (GTC) apply to all contracts, deliveries and services between Olyscake and its customers in connection with the sale of cupcakes, cakes or other baked goods.

2. Orders and Conclusion of Contract
   2.1. Orders are placed either in person, by telephone, via Instagram or via the order form on the Website.
   2.3. By placing an order, the Customer makes a binding offer to purchase the desired Products. Olyscake reserves the right to refuse orders without giving reasons.
   2.4. A contract will only be concluded once Olyscake has confirmed the Customer's order in writing.

3. Prices and Payment
   3.1. All prices are quoted in CHF and include VAT at the statutory rate.
   3.2. Payment may be made in cash or by TWINT.
   3.3. For larger orders or individually designed cakes, an advance payment of 30% is due, which must be paid in full at least 5 working days before the agreed collection/delivery.

4. Delivery and collection
   4.1. Orders must always be collected in Zurich Altstetten. The exact collection address will be notified after receipt of the order.
   4.2. Delivery shall be made by arrangement. The delivery area only includes the city of Zurich and a delivery fee of CHF 19.00 will be charged.
   4.3. In case of self-collection, the customer is obliged to collect the ordered products at the agreed time. In the event of non-collection, Olyscake reserves the right to charge the full amount.

5. Cancellation and Changes
   5.1. Orders may be cancelled free of charge up to 7 days before the agreed delivery or collection date. Personalised components of the order (such as toppers, edible pictures), cannot be cancelled and will be charged at 100%.
   5.2. For cancellations within 5 days of the delivery or collection date, Olyscake reserves the right to charge a cancellation fee of 50% of the total value.
   5.3. Changes to existing orders are possible by arrangement, provided that they are made in good time before the delivery or collection date (min. 2 days).

6. Warranty and Liability
   6.1. Olyscake warrants that the Products are free from defects at the time of delivery.
   6.2. The Customer is obliged to inspect the delivered Products for any defects immediately upon receipt. Any defects must be reported on site.
   6.3. Liability is limited to intent and gross negligence. Olyscake is only liable for slight negligence in the event of a breach of material contractual obligations.

7. Data protection
   7.1. Olyscake collects and stores personal data of the Customer only in accordance with the statutory provisions on data protection.
   7.2. Personal data will be treated confidentially and will not be disclosed to third parties unless this is necessary for the performance of the contract.

8. Final provisions
   8.1. Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
   8.2. The law of Switzerland shall apply.
   8.3. The place of jurisdiction for all disputes in connection with these GTC and the contracts is the registered office of this company (8048 Zurich).
